GENERAL RENTAL CONDITIONS

Article 1 - Purpose of the contract

The purpose of this contract is the rental of a vehicle belonging to the Lessor to a Lessee, for a duration, at a price and under conditions defined in the rental contract.

Article 2 - Use of the vehicle

The Tenant undertakes to:

  • Use the vehicle in accordance with its normal purpose;
  • Not to participate in unauthorized competitions, races or uses;
  • Do not lend, sublet or transfer the vehicle;
  • Do not transport dangerous or illegal goods;
  • Respect geographical limitations (see Article 3).

Any violation of these rules will result in the cancellation of insurance guarantees and the invoicing of all damages.

Article 2a - Conditions of validity of the driving licence

The Renter, as well as any person authorized to drive the rented vehicle, must meet the following conditions depending on the type of vehicle:

  • 50cc vehicle: be at least 18 years old and hold a valid AM or B license.
  • 125cc vehicle: be at least 20 years old and hold an A1, A2, or B license with 7 hours of training, valid for at least 2 years.
  • Yamaha TMAX 560 or equivalent (over 125cc): be at least 23 years old and hold an A2 or A license, valid for at least 2 years.

The mandatory documents to present when booking are:

  • An original driving license (legible and valid),
  • A valid identity document, - proof of address less than 3 months old (the Lessor may request this at its discretion),
  • For non-residents: an international permit if the permit is not written in French.

The Lessor reserves the right to refuse rental if the documents provided are deemed non-compliant, falsified, expired or not translated.

In the event of false declaration or non-compliance with the driving conditions, the rental will be cancelled without refund, and the Renter will remain fully liable for all damages or infractions, without the possibility of recourse to insurance.

In the event of presentation of an invalid, unsuitable or falsified license, the Lessor may cancel the rental without possible reimbursement, and retain any amount already paid as a contractual penalty.

Article 3 - Geographical limitation

Rented vehicles may only be driven in Corsica, unless with written permission from the Lessor. Any use outside this area will result in:

  • Cancellation of insurance coverage;
  • Invoicing of vehicle repatriation costs, minimum package: EUR 500.

Article 4 - Duration and extension

The rental period is set out in the contract. Any request for an extension must be confirmed in writing before the end of the contract.
Any extension without authorization will be charged at a rate of EUR 100 per day started, without prejudice to legal action.

Article 5 - Condition of the vehicle

An inventory is carried out upon delivery and return of the vehicle. The Renter is responsible for any damage not initially reported. Dated photos may be used as evidence.

Article 6 - Fuel and cleaning

  • The vehicle is delivered with a full tank of fuel and must be returned in the same condition. Otherwise, a fee of €30 + missing fuel will be charged.
  • The vehicle must be returned clean. In the event of abnormal dirtiness, a cleaning fee of €50 will be applied.

Article 7 - Deposit / security deposit

A security deposit of XXX EUR is required by bank imprint before the vehicle is handed over.
This deposit may be retained in whole or in part in the event of:

  • Vehicle damage;
  • Late return;
  • Cleaning or fuel costs;
  • Non-payment of fines.

Reimbursement is made within a maximum of 15 days, less any fees.

Article 8 - Payment and cancellation

The rental price is due in full upon reservation or delivery of the vehicle.

  • In the event of cancellation less than 48 hours before picking up the vehicle, 100% of the rental amount will be retained.
  • No refund is made in the event of early return.

Article 9 - Insurance and deductible

The vehicle is covered by Civil Liability insurance.

In the event of an accident for which the party is responsible or without an identified third party:

  • A non-compressible excess of €1,000 to €3,500 applies depending on the vehicle reserved;
  • This deductible is due even in the event of theft or vandalism.

The following cases are not covered:

  • Driving by an unauthorized person;
  • Driving under the influence of alcohol, drugs or narcotics;
  • Use of the vehicle outside of the contract or geographic area;
  • Clear negligence.

Article 10 - Liability and offenses

The Renter and authorized drivers are responsible for:

  • Of all traffic violations;
  • Payment of fines, fees and penalties.

They expressly authorize the Lessor to transmit their contact details to the authorities.

Article 11 - Termination and Disputes

The contract may be terminated automatically by the Lessor in the event of serious non-compliance with the conditions.
In the event of a dispute, the competent court will be that of the Lessor's registered office.
