GENERAL TERMS AND CONDITIONS OF RENTAL

Article 1 - Purpose of the contract

The purpose of this contract is the rental of a vehicle belonging to the Lessor to a Lessee, for a period, a price and under conditions defined in the rental contract.

Article 2 - Use of the vehicle

The Tenant agrees to:

  • Use the vehicle in accordance with its normal purpose;
  • Do not participate in unauthorized competitions, races or uses;
  • Do not lend, sublet or transfer ownership of the vehicle;
  • Do not transport dangerous or illegal goods;
  • Respect geographical limitations (see Article 3).

Any violation of these rules will result in the cancellation of insurance guarantees and the invoicing of the full amount of damages.

Article 2 bis - Conditions for the validity of the driving licence

The Renter, as well as any person authorized to drive the rented vehicle, must meet the following conditions depending on the type of vehicle:

  • 50cc vehicle: must be at least 18 years old and hold a valid AM or B license.
  • 125cc vehicle: be at least 20 years old and hold an A1, A2, or B license with 7 hours of training, valid for at least 2 years.
  • Yamaha TMAX 560 or equivalent (over 125cc): be at least 23 years old and hold an A2 or A license, valid for at least 2 years.

The documents required when booking are:

  • An original driving licence (legible and valid),
  • A valid form of identification, - proof of address less than 3 months old (the Lessor may request this at their discretion),
  • For non-residents: an international driving permit if the permit is not written in French.

The Lessor reserves the right to refuse the rental if the documents provided are deemed non-compliant, falsified, expired or not translated.

In the event of a false declaration or failure to comply with the driving conditions, the rental will be cancelled without refund, and the Renter will remain fully responsible for all damages or infractions, without recourse to insurance.

In the event of presentation of an invalid, unsuitable or falsified license, the Lessor may cancel the rental without possible refund, and retain any amount already paid as a contractual penalty.

Article 3 - Geographical Limitation

Rental vehicles may only be driven in Corsica, unless otherwise authorized in writing by the Lessor. Any use outside this area will result in:

  • Cancellation of insurance coverage;
  • Vehicle repatriation costs will be charged, minimum flat rate: 500 EUR.

Article 4 - Duration and extension

The rental period is specified in the contract. Any request for extension must be approved in writing before the end of the contract.
Any unauthorized extension will be charged at a rate of EUR 100 per day started, without prejudice to legal action.

Article 5 - Condition of the vehicle

A vehicle condition report is completed upon delivery and return. The Renter is responsible for any damage not initially reported. Dated photos can serve as proof of damage.

Article 6 - Fuel and cleaning

  • The vehicle is provided with a full tank of fuel and must be returned in the same condition. Otherwise, a fee of €30 plus the cost of the missing fuel will be charged.
  • The vehicle must be returned clean. In case of abnormal soiling, a cleaning fee of €50 will be applied.

Article 7 - Caution / Security Deposit

A security deposit of XXX EUR is required via credit card authorization before the vehicle is handed over.
This deposit may be retained in whole or in part in the event of:

  • Damage to the vehicle;
  • Late return;
  • Cleaning fees or fuel;
  • Failure to pay fines.

The refund will be made within a maximum of 15 days, less any applicable fees.

Article 8 - Payment and Cancellation

The rental price is due in full upon booking or upon delivery of the vehicle.

  • In case of cancellation less than 48 hours before vehicle pick-up, 100% of the rental amount will be retained.
  • No refund will be issued in the event of early return

Article 9 - Insurance and deductible

The vehicle is covered by third-party liability insurance.

In the event of an accident where the party is at fault or no third party is identified:

  • A non-negotiable deductible of €1000 to €3500 applies depending on the vehicle reserved;
  • This deductible is due even in the event of theft or vandalism.

The following cases are not covered:

  • Driven by an unauthorized person;
  • Driving under the influence of alcohol, drugs or narcotics;
  • Use of the vehicle outside of contract or geographical area;
  • Clear negligence.

Article 10 - Liability and Offences

The Renter and authorized drivers are responsible for:

  • Of all violations of the Highway Code;
  • Payment of fines, fees and penalties.

They expressly authorize the Lessor to transmit their contact details to the authorities.

Article 11 - Termination and Disputes

The contract may be terminated automatically by the Lessor in the event of a serious breach of the terms and conditions.
In the event of a dispute, the competent court will be that of the Lessor's registered office.
